Terms & Conditions

On 30 December 2017,  in Edinburgh, a procession will herald the start of Scotland’s Year of Young People, and will end with hundreds of torches spelling out one word #ScotWord - which describes what makes young Scottish people proud to live in Scotland ("project"). This project is being run by Underbelly Ltd, 26 Frederick Street, Edinburgh EH2 2JR ("Company"/"We"/"Our"/"Us"). Here is how you can get involved!

  • Conditions of Participation
    • By submitting a #ScotWord and/or a video about a #ScotWord, you agree that these terms and conditions are binding. By participating in the project you shall be indicating that you accept these terms and conditions.
    • This project involves an element of literacy skill and creativity, and each submission will be considered individually based on the guidelines specified in these terms and conditions.     
  • Eligibility
    • This project is open to anyone that will be aged between 8 - 26 ("young person") on 30 December 2017 who is, at the date of submission and will remain so on 30 December 2017, a resident of Scotland. Proof of eligibility may be requested (in particular to confirm age and residency). A submission will be deemed invalid if the individual fails or refuses to provide proof of residency or of age within 5 days of being requested to do so, and any videos submitted by such individuals will be deleted. 
    • Children who are aged under 18 years will not be eligible to submit a video to the project, unless, where such child is aged between 8 and 17, their parent or guardian (whose contact details were provided by the child) enters into the project on behalf of the child by approving their entry submission, where they deem it appropriate, within the timescale specified in the email communication received from the Company, as in the following example:
    • In these circumstances such parent or guardian will be the 'eligible participant' for the purposes of liaising with the Company in respect of the project. Where the parant or guardian rejects the video entry submission or such approval is not received within 7 working days, no video submissions or personal data shall be posted to the website in respect of such child.
    • Staff members of the Company and their immediate families, or any associated agencies and companies, contractors or individuals, are eligible to participate in this project where they meet the criteria set out in 2(a) above.
  • How to Participate in the Project
    • The period to enter a submission as part of the project commences at 10am on 13 October 2017 and closes at 11.59pm on 30 November 2017. It will not be possible to submit a #ScotWord or a video outside this period and no correspondence will be entered into.
    • Eligible partipants may participate in the project by:
      • submitting a #ScotWord on the website [insert link] that complies with the word guidelines; or
      • submitting a #ScotWord and uploading a video on the website, that complies with the video guidelines, explaning the reasons for selecting that #ScotWord, ("Entry Procedure").   
    • Eligible participants are required to take full responsibility for the content of their submission and for ensuring that their submission complies with these terms and conditions.  For this purpose, “submission content” includes any content that is submitted, uploaded, published, communicated or used in connection with the project.
    • Any costs involved in submitting an entry, for example internet charges or filming equipment, will be the responsibility of the eligible participant.
    • Submissions will be deemed invalid if they breach these terms and conditions as determined by the Company in its sole discretion or any other content requirements notified by the Company, and such submissions will not feature on the website.

  • Word Requirements:
    • Only one word should be submitted, for example 'Historic' not a phrase like 'Scotland has lots of history'.
    • It can be a word in the English dictionary, a Gaelic word or a Scottish Word, for example "Auld". 
    • It cannot be a swear word, or a word that has an offensive or threatening meaning. Please note that the company has profanity filtering functions on the website, therefore certain submissions may be automically rejected.

  • Video Requirements:
    • Any video submitted should include (i) for any individuals under 18, the FIRST NAME (only), (please note that an individual that is 18 or over may include their full name if they voluntarily chose to provide such personal information, but this may be edited in any final video footage compiled by the Company) (ii) the chosen #ScotWord, and (iii) an explanation of why that word has been chosen, in less than 60 seconds.  The video should only show the young person's head and shoulders, and the young person should not show anything that could identify where the young person lives.
    • The video should only include the young person and no-one else, and it should not reveal any information about anyone else. 
    • The video should be filmed in  a landscape format
    • The video should not advertise any products.
    • The video should not include any literary, dramatic, musical or artistic work, nor any audio-visual or sound recording that is subject to copyright, unless you have permission from the copyright owner. If you have any doubts about whether you have the right to include any content (for example, recorded music) do not include it. By including any such content, you represent and warrant that you have the permission of the relevant copyright owner to do so and that this permission allows the Company to use the video submission in accordance with these terms and conditions.
    • Don’t swear, or use offensive or threatening language. Don’t use inappropriate behaviour such as violence, sexually explicit behaviour, harassment, or solicitation, or promote any kind of illegal act. If you do any of these things (or otherwise breach these terms), your film will not be uploaded, and you may be reported to the police.
  • Project Outcome
    • The selected #ScotWord will be displayed at Edinburgh's Hogmanay Torchlight Procession  on the 30 December 2017, when thousands of people take part in a torchlight procession through the streets of Edinburgh and will be used over the course of the year as part of the project initiative.
  • Adjudicating the Submissions and Selecting the #ScotWord
    • Each entry submitted by an eligible participant will be reviewed by a member of staff of the Company against a judging criteria of literacy skill, creativity and originality and to ensure that any submissions  that contain misspellings shall be included (but for clarity, the spelling shall be corrected) and also to vet that all submissions comply with these terms and the word and video guidelines.
    • A panel of up to 32 individuals (individuals aged between 16-26 from each local authority in Scotland) at the sole discretion of the Company (collectively, the "#ScotWord Champions"), shall be responsible for down-selecting, depending on the number of eligible entries, between 3 - 10 #ScotWords for a shortlist  ("Shortlist").  This Shortlist shall be publically announced by the Company on the 4 December 2017 (both on the website and in the media).
    • The Shortlist shall be open to the general public to vote on the website. Voting shall be open until 12pm on 17 December 2017. On the 18 December 2017, the Company shall confirm internally which #ScotWord received the highest number of votes, but no public announcement shall be made until the reveal of the torchlight procession on 30 December 2017.
    • If the  winning #ScotWord was only suggested by one eligible participant, the Company may invite such individual to participate in the torchlight procession. This opportunity would not be transferable, exchangeable, or redeemable for cash, and all associated expenses, including but not limited to, meals, spending money, accommodation and transport would be the responsibility of such individual.
  •  Legal Provisions
    • By submitting a video, you grant us permission to use it on www.edinburghshogmanay.com ("Website") and also on Edinburgh’s Hogmanay’s social media channels throughout the Year of Young People in 2018 and until the end of 2019.  The property and any copyright or other intellectual property rights in the content available on the Website (“Online Content”) belongs to us . 
    • We may also share your video with the Scottish Government’s Year of Young People website www.yoyp2018.scot and with Young Scot www.young.scot, and with the social media channels of those organisations as further detailed in our fair processing notice. You should not provide a video submission or any personal data if you do not wish the content to be shared in this manner.  
    • By participating in this project you grant the Company a perpetual, non-exclusive, transferable, sublicenseable, irrevocable, royalty-free, fully paid-up, worldwide licence to use, reproduce, publish, distribute and disseminate all intellectual property rights in  submissions, and consent to the Company using, reproducing or editing and/ or adapting any entry, in broadcast, electronic and print media, in whole or in part without attributing that entry to the person who created it. 
    • By participating in this project, you hereby unconditionally and irrevocably waive any moral rights relating to your entry in favour of the Company, and you agree that the Company may reproduce or publish your entry without attributing authorship. 
    •  By uploading a submission, you acknowledge that your personal data will be used by the Company in the manner set out in the fair processing notice provided to you at that time, for the purposes of administering the project.  The collection, use and processing of personal data will be conducted in accordance with the full privacy policy which can be viewed at [insert link].   
    • We may contact eligible participants (i.e. parent or guardian where a young person is under 18, or any young person aged over 18 where they have provided contact details) regarding this project  - for example to confirm whether we may use a video submission as part of a wrap up feature film, or in connection with the Hogmanay torchlight procession, but we will not contact you for marketing reasons unless, where you are over 18, you have explicitely consented to this (and have not subsequently opted out). 
    • Except for guarantees, warranties and conditions implied by law which cannot be excluded or limited, neither the Promoter nor any of its affiliates make any guarantees, representations or warranties, express or implied, regarding the quality or suitability of any prizes awarded under these Conditions of Entry.
    • If the project is not capable of running as planned for any reason, the Company reserves the right to cancel, terminate, modify or suspend the project. 
    • These terms and conditions are subject to Scots Law and the exclusive jurisdiction of the Scottish courts.
